Waiver of Liability

Please review the following agreement carefully. By clicking “I Agree,” you acknowledge and accept the terms outlined below.

1. Acknowledgment and Assumption of Risk

You understand that use of EVO Golf’s facilities, simulators, equipment, and services involves inherent risk—including but not limited to injury, property damage, or loss. You voluntarily assume all risks associated with your participation.

2. Waiver and Release of Liability

In consideration of being granted access to the EVO Golf facility, you release and discharge EVO Golf, its owners, employees, contractors, and representatives from any and all claims, demands, actions, or liabilities related to injury, loss, or damage arising from your use of the facility—including those resulting from the negligence of EVO Golf, to the extent permitted by law.

3. Use of Facility and Equipment

You agree to use all facilities and equipment in accordance with posted guidelines and staff instructions. You accept responsibility for any damage caused by misuse, negligence, or failure to follow instructions.

4. Medical Conditions and Emergency Care

You confirm that you are in good health and physically capable of participating in activities at EVO Golf. You acknowledge that EVO Golf does not provide on-site medical services. In the event of a medical emergency, you authorize EVO Golf to seek appropriate care on your behalf and accept financial responsibility for any associated costs.

5. Minors

If you are signing on behalf of a minor, you confirm that you are the minor’s legal guardian and accept all risks, responsibilities, and liabilities as outlined in this waiver.

6. Indemnification

You agree to indemnify and hold harmless EVO Golf, its staff, ownership, and affiliates from any claims, damages, or costs resulting from your actions, conduct, or negligence while using the facility.

7. Photography and Media Release

By agreeing to this waiver, you consent to the use of any photos or video taken during your time at EVO Golf for marketing or promotional purposes, without compensation. You may opt out by contacting EVO Golf directly.

8. Governing Law

This waiver shall be governed by the laws of the Province of Manitoba. Any legal disputes will be resolved in the courts of Brandon, Manitoba.
